III.     What data do we collect and on what basis?

1. Cookies

The Internet pages partly use so-called cookies. Cookies do not damage your computer and do not contain viruses. Cookies aim to make our offer more user-friendly, more effective and safer. Cookies are small text files that are stored on your computer and saved by your browser.

Most of the cookies we use are so-called “session cookies”. They are automatically deleted at the end of your visit. Other cookies remain stored on your end device until you delete them. These cookies enable us to recognize your browser during your next visit.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, accept cookies for certain cases or generally exclude and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be restricted.

Cookies, which are necessary to carry out the electronic communication process or to provide certain functions requested by you (e.g. shopping cart function), are stored to safeguard our legitimate interests, since the website operator has a legitimate interest in storing cookies for the technically error-free and optimised provision of its services. Insofar as other cookies are stored (e.g. cookies for analysing your surfing behaviour), these are dealt with separately in this privacy notice.

2. Server-Log-Files

The provider of these webpages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP address

This data will not be merged with data from other data sources.

This data is collected to protect our legitimate interests, as the website operator has a legitimate interest in the technically error-free presentation and optimization of his website. For this purpose the server log files must be collected.

3. Contact form

If you send us enquiries using the contact form, the information provided in the enquiry form and the contact data you provided therein will be stored by us for the purpose of processing the enquiry and in the event of follow-up questions. This data will not be passed on to third parties without your consent.

The processing of the data entered in the contact form is carried out on the basis of your consent. You can withdraw this consent at any time. For this purpose, an informal e-mail notification to us is sufficient (the contact details are provided in this privacy notice). The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

The comments are stored on the basis of your consent. You can withdraw your consent at any time. For this purpose, an informal e-mail notification to us is sufficient. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

4. Newsletter

4.1       Newsletter subscription and unsubscription

If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. Further data will not be collected or will only be collected on a voluntary basis. We use these data exclusively for the dispatch of the requested information and do not pass these on to third parties.

The processing of the data entered in the newsletter registration form takes place exclusively on the basis of your consent. You can withdraw at any time your consent to the storage of data, e-mail address and their use to send the newsletter, for example by sending an e-mail to info(at)emerald-casa.ch or by clicking on the link provided in each newsletter. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

4.2       MailChimp as service provider

We use the provider MailChimp to send our newsletter. MailChimp is a product of The Rocket Science Group, LLC, 512 Means Street, Suite 404, Atlanta, GA 30318.

The data stored during the subscription to the newsletter will be transferred to The Rocket Science Group and stored by The Rocket Science Group. The data entered during registration will not be passed on to other third parties. After registration, MailChimp will send you an e-mail to confirm your registration. In addition, MailChimp offers various analysis options on how the sent newsletters are opened and used, e.g. how many users an e-mail was sent to, whether e-mails were rejected and whether users unsubscribed from the list after receiving an e-mail. However, these analyses are only group-related and are not used by us for individual evaluation. MailChimp also uses the Google Analytics tool from Google Inc. and may link it to the newsletters. Further details about Google Analytics can be found in this privacy notice in the section “Google Analytics”. Further information on data protection at MailChimp can be found at: http://mailchimp.com/legal/privacy/

We may also use your information to invite you to customer events. You may at any time waive your right to receive information or object to data processing for marketing purposes by notifying us accordingly (by post, e-mail or telephone). In this respect, see details of your right of objection in Chapter VII below.

6. Google Analytics

This website uses functions of the web analysis service Google Analytics, whose provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

6.1       Use of cookies

Google Analytics uses cookies. The information generated by the cookies about your use of this website is usually transferred to a Google server in the USA and stored there.

The storage of Google Analytics cookies and the use of this analysis tool are done to protect our legitimate interests. The website operator has a legitimate interest in analysing user behaviour in order to optimise both his website and his advertising.

6.2       IP Anonymization

We have activated the IP anonymization function on this website. This means that Google will shorten your IP address within the European Economic Area and Switzerland before it is transmitted to the USA. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data.

6.3       Browser Plugin

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. You can also prevent Google from collecting the data generated by the cookies and related to your use of the website (including your IP address) as well as Google from processing this data by downloading and installing the browser plug-in available under the following link: https://tools.google.com/dlpage/gaoptout?hl=en

6.4       Objection to data collection

You can prevent Google Analytics from collecting your information by clicking on the following link. An opt-out cookie is used to prevent your data from being collected on future visits to this website: Disable Google Analytics.

7. Third-party plug-ins and tools: Google Web Fonts

This page uses so-called web fonts provided by Google for the uniform display of fonts. The Google Fonts are installed locally on our server. There is no connection to Google servers.

IV. Who gets my data?

1. Within Emerald Casa SA

Within Emerald Casa SA, those functions that need your data to fulfil our contractual and legal obligations will have access to it.

2. Third parties

We only pass on information about you to third parties if this is required by law, if this is necessary to fulfil contractual or pre-contractual obligations or if we are authorised to provide information.

3. Service providers

We may engage service providers and auxiliary persons to fulfil the above-mentioned purposes, provided that they undertake to maintain the confidentiality of the data. Service providers can be amongst others companies in the categories of IT services (including hosting service providers; e.g. Google Analytics from Google Inc.), direct mailing providers (e.g. MailChimp from The Rocket Science Group), consulting companies. To protect your personal data, we ensure that our data security standards are adhered to by these contractors.

4. Further cases

In the event of the sale of our business or parts thereof to another company or in the event of the restructuring of our business, personal data will be passed on in order to enable you to continue to use our products and services. Typically, we also share personal information with potential purchasers when we consider a partial or total sale or spin-off of a business, or a partial or total divestment of a business. We take precautions to ensure that these potential purchasers take care of the security of the data.

We will disclose personal information as necessary to exercise or protect legal rights, including our legal rights and the legal rights of our employees and other rights holders, or in response to requests from individuals or their representatives to protect their legal rights or the legal rights of others.

V. Is data transferred to a third country or to an international organisation?

The recipients mentioned in the previous section may also be located outside Switzerland and outside the European Economic Area. In this case, Emerald Casa SA requires that these recipients take appropriate measures to protect personal data, which are laid down in a binding legal agreement, unless the destination country is recognised as a country that guarantees an adequate level of data protection. With regard to recipients of the data who are resident in the USA, certification in accordance with the EU-USA and Swiss-USA Privacy Shield Frameworks (https://www.privacyshield.gov/welcome) offers a sufficient guarantee. Both Google Inc. (provider of Google Analytics) and The Rocket Science Group LLC (provider of MailChimp) participate in the Privacy Shield Framework. Data may also be transferred to or from third countries where the execution of your orders requires it, where the transfer of data is required by law, or where you have consented to such transfer.

Please contact us if you wish to review the guarantees that have been agreed for the data transfer.

VI. How long will my data be stored?

We store your personal data in personal form as long as it is necessary for the specific purpose for which we have collected it.

The data you enter in the contact form will remain with us until you request us to delete it, withdraw your consent to its storage or the purpose for which it was stored no longer applies (e.g. after your request has been processed).

We also store personal data if we have a legitimate interest in the storage. This may in particular be the case if we need personal data in order to assert or defend claims, for archiving purposes, to guarantee IT security or if limitation periods for contractual or non-contractual claims are running. In addition, we store your personal data as long as they are subject to a statutory retention obligation (e.g. fulfilment of commercial and tax retention obligations).

We will delete or anonymise your personal data after the expiry of the aforementioned periods.

VII.    What data protection rights do I have?

1. Information, blocking, deletion and correction

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, their origin and recipient and the purpose of data processing and, if applicable, a right to rectification, blocking or erasure of this data. You can contact us at any time at the address stated in this privacy notice for this purpose and for further questions on the subject of personal data.

2. Right to data portability

You have the right to have data, which we process automatically on the basis of your consent or in fulfilment of a contract, handed over to you or to a third party in a structured, commonly used and machine-readable format. If you request the direct transfer of the data to another data controller, this will only be done as far as it is technically feasible.

3. Right to restriction of processing

You have the right to demand the restriction of the processing of your personal data. You can contact us at any time at the address stated in this privacy notice. The right to restrict the processing may be exercized in the following cases:

If you dispute the accuracy of your personal data stored with us, we usually need time to verify this. For the duration of the check, you have the right to demand that we restrict the processing of your personal data.

If the processing of your personal data has taken place unlawfully, you can demand the restriction of data processing instead of deletion.

If we no longer need your personal data, but you need it for the exercise, defence or assertion of legal claims, you have the right to demand the restriction of the processing of your personal data instead of deletion.

If you have lodged an objection (sections below), we have to verify whether our legitimate grounds override your interests. As long as it is not yet clear whose interests predominate, you have the right to demand the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, such data – apart from its storage – may only be processed with your consent or for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of an important public interest.

4. Withdrawal of your consent to data processing

If a data processing process takes place with your express consent, you can withdraw an already given consent at any time. For this purpose, an informal e-mail notification to us is sufficient. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

5. Right of objection against data processing in special cases

If the data processing is carried out in the public interest or on the basis of a balancing of interests, you have the right at any time to object to the processing of your personal data for reasons arising from your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which a processing is based can be found in this privacy notice. If you lodge an objection, we will no longer process your personal data concerned unless we can prove compelling reasons worthy of protection for the processing which outweigh your interests, rights and freedoms or the processing serves the assertion, exercise or defence of legal claims.

If your personal data are processed for the purpose of direct marketing, you have the right to object at any time to the processing of your personal data for the purpose of such advertising; this also applies to profiling insofar as it is connected with such direct marketing. If you object, your personal data will no longer be used for the purpose of direct marketing.

6. Right of appeal to the competent supervisory authority

In the event of violations of data protection legislation, the persons concerned have the right to lodge a complaint with a supervisory authority, in particular at their place of residence, place of work or at the place of the alleged violation. The right of appeal exists without prejudice to other administrative or judicial remedies.

VIII.   Data security

Emerald Casa SA has taken appropriate technical measures (e.g. encryption, pseudonymisation, logging, access restrictions, data security etc.) and organisational measures (e.g. instructions to our employees, confidentiality agreements, checks etc.) to ensure the security of the collected and processed data and to protect it from unauthorised access, misuse, loss, falsification or destruction. Access to the data is only permitted to those persons who need it for the performance of their duties.

This website also uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

However, security risks can generally not be completely excluded; certain residual risks are usually unavoidable. In particular, since no complete data security can be guaranteed for communication by e-mail or similar means of communication, we recommend that you choose a secure means of communication (e.g. dispatch by post) for particularly confidential information.
